Terms of Use
Terms for using our websites and support portal.
These terms govern public website use and supplement, but do not replace, written client agreements.
Effective Date: June 01, 2011
Last Updated: July 24, 2026
These Terms of Use (“Terms”) govern access to and use of maineit.org, support.maineit.org, and any Maine IT Solutions website or online service that links to these Terms (collectively, the “Site”). The Site is operated by Maine IT Solutions (“Maine IT Solutions,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Purpose of the Site
The Site provides information about Maine IT Solutions and our professional IT services. It may also allow visitors to request information, contact us, access the client support portal, submit support requests, and communicate with our staff.
2. Informational Content Only
Public website content is provided for general informational purposes. Nothing on the public Site constitutes a binding proposal, guaranteed price or service level, warranty, legal or regulatory advice, security assessment, representation that a particular service is suitable for your organization, or commitment to provide services.
Service scope, pricing, responsibilities, warranties, support obligations, and service levels are established only through a written agreement accepted by Maine IT Solutions and the applicable client.
3. No Client Relationship Created by Website Use
Visiting the Site, sending an email, submitting a contact form, or requesting information does not by itself create a client relationship. A client relationship is established only through an applicable written agreement.
4. Client Agreements Control
Services for existing clients may be governed by a managed-services agreement, master-services agreement, statement of work, service order, project agreement, confidentiality agreement, service-level agreement, or other written terms. If these Terms conflict with an applicable written client agreement, the client agreement controls regarding the contracted services.
5. Client Support Portal
Existing clients may access support services through support.maineit.org. The support portal is intended only for authorized users.
You are responsible for maintaining the confidentiality of account credentials, protecting authentication factors, restricting access to authorized personnel, notifying us promptly of suspected unauthorized access, submitting accurate information, avoiding unnecessary submission of highly sensitive information, and following your organization’s security policies and applicable client agreements.
You may not share an account with an unauthorized person or attempt to access another client’s account, tickets, systems, or information. Support requests are handled under the applicable client agreement. Submission of a ticket does not guarantee a particular response time unless a written service-level commitment applies.
Do not use ordinary email or a public contact form for urgent security incidents, active compromises, passwords, authentication codes, private encryption keys, regulated information, or other highly sensitive data.
6. Permitted Use
You may use the Site only for lawful business and informational purposes and in accordance with these Terms. You may view, download, and print reasonable portions of publicly available content solely for internal informational use, provided proprietary notices remain intact.
7. Prohibited Conduct
You may not:
- Violate applicable law or regulation;
- Attempt unauthorized access to any Site, server, network, account, system, or data;
- Scan, probe, test, or assess vulnerabilities without prior written authorization;
- Conduct penetration testing or security research without prior written authorization;
- Circumvent authentication, authorization, rate limits, firewalls, or other safeguards;
- Introduce malicious code or conduct denial-of-service activity;
- Interfere with Site availability, operation, performance, or security;
- Use automated tools in a manner that burdens the Site, except ordinary search-engine indexing;
- Impersonate another person or organization or misrepresent your authority;
- Submit false, misleading, fraudulent, unlawful, threatening, or infringing material;
- Attempt to access another client’s information;
- Remove proprietary notices;
- Use Site content to train an artificial-intelligence or machine-learning system without written permission; or
- Assist another person in prohibited conduct.
We may block or restrict traffic, accounts, addresses, devices, or activity that we reasonably believe threatens the Site, our systems, clients, users, or others.
8. User Submissions
If you submit information, messages, files, feedback, or other material, you represent that you have authority to submit it, it is accurate to the best of your knowledge, it does not violate law or another party’s rights, it contains no malicious code, and you obtained any required permissions.
You retain ownership of your submission. You grant Maine IT Solutions a nonexclusive right to receive, store, reproduce, transmit, review, and use it as reasonably necessary to respond, evaluate an inquiry, provide support or contracted services, maintain records, protect security, comply with law, and enforce agreements.
9. Intellectual Property
The Site and its content, including text, graphics, branding, logos, design, arrangement, code, and original materials, are owned by or licensed to Maine IT Solutions and protected by applicable intellectual-property laws. Except for the limited permission expressly stated in these Terms, no right or license is granted.
You may not copy, modify, reproduce, distribute, publish, display, sell, license, create derivative works from, or commercially exploit Site content without prior written permission.
10. Feedback
If you voluntarily provide suggestions, ideas, or feedback concerning the Site or our services, you grant Maine IT Solutions a perpetual, worldwide, nonexclusive, royalty-free right to use that feedback without restriction or compensation. This does not grant us ownership of confidential client information governed by a separate agreement.
11. Privacy
Our collection and use of personal information are described in our Privacy Policy. By using the Site, you acknowledge that information will be handled in accordance with that policy and any applicable client agreement.
12. Third-Party Services and Links
The Site may link to third-party websites, software, platforms, products, or services. A link does not imply endorsement, sponsorship, or control. Maine IT Solutions is not responsible for a third party’s availability, accuracy, content, security, privacy practices, terms, products, or services.
13. Website Availability and Changes
We may modify, suspend, restrict, replace, or discontinue any part of the Site at any time. We do not guarantee uninterrupted availability, error-free operation, current or complete content, immediate correction of errors, compatibility with every device or browser, or freedom from harmful components.
14. No Security Guarantee
We use safeguards designed to protect the Site, but no system or transmission method can be guaranteed completely secure. Access to the Site is not a representation that your own systems, devices, networks, or information are secure. General cybersecurity information on the Site is not a substitute for an assessment of your environment.
15. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PUBLICLY AVAILABLE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MAINE IT SOLUTIONS DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES CONCERNING THE SITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
This disclaimer does not alter warranties expressly included in a separate written client agreement.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAINE IT SOLUTIONS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SITE, INCLUDING LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR USE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE PUBLIC SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS.
These limitations do not apply where prohibited by law and do not modify liability provisions in an applicable client agreement.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Maine IT Solutions and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from your violation of these Terms, unlawful use of the Site, infringement of another party’s rights, submitted material, or unauthorized access to or misuse of the Site.
18. Suspension and Termination
We may suspend, restrict, or terminate access if we reasonably believe you violated these Terms, an account was compromised, activity threatens security or availability, use creates legal or operational risk, a client relationship ended, or suspension is otherwise permitted by an applicable agreement.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles. Unless an applicable written agreement states otherwise, legal proceedings arising from these Terms or the public Site must be brought in a state or federal court having jurisdiction in Maine, and you consent to those courts’ jurisdiction and venue.
20. Changes to These Terms
We may update these Terms periodically. We will revise the “Last Updated” date when changes are posted. Changes become effective when posted unless a later date is stated. Continued use after the effective date constitutes acceptance of the updated Terms.
21. General Terms
If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, sale of assets, or similar transaction.
These Terms and the Privacy Policy constitute the entire agreement regarding use of the public Site. They do not replace or amend an applicable signed client agreement.
